Terms of Service

These Terms of Service (“Terms”) govern your use of the ByteWire Forensics website at bytewireforensics.com (the “Site”), the ByteWire Forensics Academy learning platform (the “Academy”), and any related services provided by Bytewire Forensics LLC, a Wisconsin limited liability company doing business as ByteWire Forensics (“we,” “us,” or “our”). By accessing or using the Site or Academy, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing the Site, creating an Academy account, or engaging ByteWire Forensics for consulting services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
ByteWire Forensics provides the following services through the Site and related engagements:
- Consulting Services. Digital forensics, risk advisory, incident response, and technical surveillance countermeasures (TSCM), delivered under separate statements of work.
- ByteWire Forensics Academy. An online learning platform offering professional development courses in cybersecurity, digital forensics, cybercrime investigations, and AI literacy.
- Informational Content. Insights articles, thought leadership, and industry resources published on the Site.
3. Academy Account Terms
3.1 Registration
To access Academy courses, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
3.2 Account Security
Passwords must meet minimum complexity requirements (at least 10 characters with uppercase, lowercase, numeric, and special characters). We enforce rate limiting on authentication endpoints. Repeated failed login attempts may result in temporary account lockout.
3.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or compromise the security of the platform. You may request account deletion at any time by contacting us.
4. Acceptable Use
When using the Site and Academy, you agree not to:
- Attempt to gain unauthorized access to any part of the Site, Academy, or associated systems.
- Use automated tools (bots, scrapers, crawlers) to access or extract content without written permission.
- Interfere with or disrupt the Site’s operation, servers, or network infrastructure.
- Impersonate another person or entity, or misrepresent your affiliation with any entity.
- Upload malicious code, files, or content through any intake point (contact forms, registration, etc.).
- Reproduce, redistribute, or commercially exploit Academy course content without written authorization.
- Use information obtained from the Site for phishing, social engineering, or any form of fraud.
5. Intellectual Property
5.1 Website Content
All content on the Site—including text, graphics, logos, images, course materials, and software—is the property of ByteWire Forensics or its licensors and is protected by copyright, trademark, and other intellectual property laws.
5.2 Academy Course Materials
Course content, assessments, and certificates are licensed for personal professional development only. Redistribution, recording, or commercial use of Academy materials is prohibited without express written consent.
5.3 Certificates
ByteWire Forensics Academy certificates attest to course completion and quiz performance. They do not constitute professional certifications, licenses, or regulatory credentials. ByteWire Forensics Academy courses are designed to support professional development and align with recognized frameworks (NIST CSF, ISO 27001, etc.), but completion does not guarantee compliance with any regulatory standard.
6. Framework Alignment Disclaimer
ByteWire Forensics references industry frameworks and standards—including NIST CSF, ISO 27001, ISO 27002, PCI DSS, GDPR, CCPA, and other jurisdiction-specific frameworks—as alignment guideposts for our services and curriculum. These references indicate that our approach is informed by and aligned withthese frameworks. They do not represent formal certification, accreditation, or endorsement by the organizations that maintain these standards unless explicitly stated.
7. Consulting Services
Consulting engagements (digital forensics, risk advisory, incident response, TSCM) are governed by separate statements of work, master service agreements, or engagement letters. These Terms apply to the Site and Academy; consulting-specific terms are defined in the applicable engagement documents.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- ByteWire Forensics provides the Site and Academy on an “as is” and “as available” basis without warranties of any kind.
- We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
- ByteWire Forensics shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Academy.
- Our total liability for any claim arising under these Terms shall not exceed the amount you paid to ByteWire Forensics in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless ByteWire Forensics, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your use of the Site or Academy, violation of these Terms, or infringement of any third-party rights.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Waukesha County, Wisconsin.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be indicated by updating the “Last Updated” date. Continued use of the Site or Academy after changes constitutes acceptance of the revised Terms.
12. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
